1. INTRODUCTION

The domain name https://paisaguru.net and its related sub-domains, sites, services, servers, and tools, including the PaisaGuru Android Mobile Application (collectively, the "Platform") is owned and operated by PaisaGuru ("Company", which expression shall, unless it be repugnant to the context thereof, be deemed to include its successors, affiliates, and permitted assigns). The Company is inter alia engaged in the business of providing informational and educational financial content to the Users ("Services").

The Company is committed to respecting the User's online privacy and recognizes the need for appropriate protection and management of any information the User shares with the Company on the Platform. This Privacy Policy ("Privacy Policy") explains how the Company will collect, use, share and process information in relation to the Services provided on the Platform.

This Privacy Policy shall be deemed to be incorporated into the Terms of Use ("Terms") and shall be read in addition to the Terms. In the event of any conflict between this Privacy Policy and the Terms, the interpretation placed by the Company shall be final and binding on the User.

By accepting this Privacy Policy, through an affirmative action, the User provides free, specific, informed, unconditional and unambiguous consent to the Company and understands and agrees to the collection, use, sharing and processing of Personal Information (defined below) as described herein. If the User voluntarily shares information about a third party through the Platform, the User confirms that such person is aware and has consented to such sharing. This Privacy Policy applies to all current and former visitors, Users and others who access the Platform.

2. SCOPE

This Privacy Policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023 and the rules made thereunder. This Privacy Policy does not require any physical, electronic, or digital signature.

By agreeing to this Privacy Policy, accessing or using the Platform, or otherwise clicking to accept this Privacy Policy when prompted, the User undertakes that the User has the capacity to enter into a legally binding contract vide this Privacy Policy, which constitutes a legally binding document between the User and the Company under applicable law, in particular, the Indian Contract Act, 1872. The Company will collect and process the User's personal information carefully, only for the purposes described in this Privacy Policy and only to the extent necessary as defined herein and within the scope of the applicable legal regulations.

Please read the terms and conditions of this Privacy Policy carefully before accepting the same and/or accessing or using the Platform. By accessing or using the Platform or otherwise clicking to accept this Privacy Policy when prompted, the User agrees to the terms of this Privacy Policy.

This Privacy Policy describes the types of information the Company collects, why and how the Company uses the information, with whom the Company shares it, and the choices the User can make about the Company's use of the information. This Privacy Policy also describes the measures the Company takes to protect the security of the information and how the User can contact the Company about its privacy practices.

This Privacy Policy describes the Company's current data protection policies and practices and may be amended/updated from time to time. The Company will notify the User at least once in a year, or whenever there is a material change, by email or by posting a conspicuous notice on the Platform. The Privacy Policy shall come into effect from the date of such update. The User's continued use of the Platform following any update will imply unconditional acceptance of such changes.

3. CONSENT

By performing the affirmative action as deemed fit by the Company, the User expressly, freely, unconditionally, and unambiguously consents to the Company's specified use and disclosure of the User's Personal Information (defined below) in accordance with this Privacy Policy. If the User does not agree with the terms of this Privacy Policy, the User should not accept this Privacy Policy or use the Platform.

4. TYPES OF INFORMATION

Personal Information is defined as any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available, is capable of identifying such person.

Personal Information: Information that may be used to identify the User, including but not limited to first and last name, telephone number, and device IP address captured at the time of policy acceptance. The Company limits the collection of Personal Information to that which is necessary for its intended purpose.

Non-Personal Information: Information that does not specifically identify an individual, including browser type, Internet Service Provider (ISP), operating system, IP address, device details, screen resolution, usage statistics, and other technology information from devices used to access the Platform ("Non-Personal Information").

Usage Information: Data collected automatically through the Platform via Google Play and Firebase Analytics, including system administrative data, statistical and demographical data, Platform traffic, time spent on the Platform, number of visits, and other behavioural information indicating the mode and manner of use of the Platform ("Usage Information").

Personal Information, Non-Personal Information, and Usage Information hereinafter shall be referred to as "Information".

5. COLLECTION OF INFORMATION

The Company may collect Information from the User when the User: (a) accesses the Platform using their registered mobile phone number; (b) voluntarily participates in campaigns, questionnaires or surveys conducted by the Company; and/or (c) voluntarily provides feedback in relation to the Services.

The User hereby acknowledges and agrees that all Information is provided voluntarily and is not subject to any undue influence.

The Company may use local storage and IndexedDB on the User's device to store preferences, session data, and cached content to improve the Platform experience. This data resides on the User's device and is not transmitted to external servers except where necessary to provide the Services.

Information collected by the Company from a particular browser or device may be used with another computer or device that is linked to the browser or device on which such information was collected.

6. USE OF INFORMATION

The Company uses the Information the User provides to: (a) manage the User's access to the Platform; (b) fulfil the User's requests for Services offered on the Platform; (c) respond to the User's queries via email; (d) provide the User with information about Services available on the Platform; (e) resolve technical problems and improve the Platform; (f) improve the Services and content on the Platform and the User's experience; and (g) manage the Company's relationship with the User.

The Company may use the Information to monitor the User's use of the Platform and may review and analyse the Information provided by the User to provide customized Services.

The Company may use Non-Personal Information or Usage Information for internal business purposes such as data analysis, research, developing new Services and/or features, and identifying usage trends. All data used in analysis will be in anonymised form.

Subject to and in accordance with applicable laws, the Company has the right to use the User's Information for the purpose of conducting promotional/marketing related activities on the Platform.

7. INFORMATION SHARING

The Company maintains the User's Information on Google Cloud Platform servers. The Information is made accessible to employees, agents or partners of the Company and third-parties only on a need-to-know basis.

The Company does not rent, sell, or share any personal and identifiable Information with other people or non-affiliated entities, except with the User's consent or to provide Services the User has requested, or under the following circumstances:

a) The Company may share Information with the Company's employees to contact the User via email for the provision of Services being availed by the User.

b) The Company engages the following third-party service providers who may have limited access to Information: Google Cloud Platform (infrastructure and storage), Firebase (authentication and analytics), Google Gemini AI (AI responses), Google Cloud Text-to-Speech (audio generation), and GoDaddy (website hosting). These providers are not authorised to use the Information beyond what is required to perform their functions.

c) The Company may share Information with government authorities in response to subpoenas, court orders, or other legal processes; to establish or exercise legal rights; to defend against legal claims; or as otherwise required by law.

8. DISCLOSURE TO ACQUIRERS

The Company may disclose and/or transfer Information to an investor, acquirer, assignee or other successor entity in connection with a sale, merger, or reorganization of all or substantially all of the Company's equity, business or assets.

9. CONTROL OVER THE USER'S PERSONAL INFORMATION

The User may request information regarding the processing of their Personal Information by submitting a written request to the Company at contact@paisaguru.net. Upon receipt of such request, the Company shall provide a summary of the relevant processing activities.

The User has the right to withdraw consent at any point by emailing contact@paisaguru.net. Once the User withdraws consent, the Company shall immediately cease to fulfil the purposes for which the said Personal Information was sought, and may restrict the User from using the Services.

If the User wishes to delete their account and discontinue using the Services, the User may submit a deletion request at paisaguru.net/delete-account or by writing to contact@paisaguru.net with their registered mobile number. The User's account and associated personal data will be deleted within 3 days of the request.

10. RECTIFICATION / CORRECTION / ERASURE OF PERSONAL INFORMATION

The User shall have the right to review, modify, correct, update, erase or delete their Personal Information. The User understands that any such modification or deletion may affect the User's ability to use the Platform and the Company's ability to provide its Services.

The Company reserves the right to verify and authenticate the User's identity before actioning any such request. Access to or correction, erasure or deletion of Personal Information may be denied or limited if it would violate another person's rights or is not otherwise permitted by applicable law.

The User may send requests for rectification or erasure to contact@paisaguru.net citing the reason. The Company will incorporate the changes within 72 (Seventy Two) working hours, subject to validation and verification requirements.

11. RIGHT TO NOMINATE

The User shall have the right to nominate any individual who shall exercise the User's rights on their behalf in the event of death or any incapacity.

12. TERM OF STORAGE OF PERSONAL INFORMATION

The Company shall store the User's Personal Information for such period as may be required and permitted by law or for a period necessary to satisfy the purpose for which the Personal Information has been collected. Retention periods vary depending on the nature of the information and the User's interactions with the Company.

The User agrees not to submit any false information or any illegal or damaging content to the Platform.

The Company reserves the right to terminate access to the Platform in response to any concerns about false, illegal, or damaging content, or for any other reason at its sole discretion.

13. LOCAL STORAGE AND TRACKING

The PaisaGuru Android App uses local storage and IndexedDB on the User's device to store user preferences, language settings, session data, and cached content. This data is stored locally on the User's device and is not a cookie in the traditional browser sense.

The Company's website (paisaguru.net) may use standard web cookies for traffic monitoring via GoDaddy's website hosting platform. These cookies do not collect personally identifiable information and are used solely to understand how visitors interact with the website.

The User may clear locally stored data at any time by uninstalling the App or clearing app data via their device settings.

14. PROTECTION OF INFORMATION

The Company has taken adequate measures to protect the security of Information and to ensure that the User's choices for its intended use are honoured. The Company takes robust precautions to protect the User's data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

The Company ensures the encryption of all Information transmitted and stored within the Platform using industry standards and protocols, including physical, technical and administrative security measures. Wherever possible, Non-Personal Information shared with AI tools shall be anonymised to protect the User's identity. While the Company strives to protect Information, absolute security when data is transmitted over the internet cannot be guaranteed.

For any loss or theft of Information due to unauthorized access to the User's device or other reasons solely attributable to the User, the Company shall not be held liable. The Company shall not be responsible for any breach of security or actions of any third parties or events beyond the Company's reasonable control including but not limited to acts of government, computer hacking, unauthorised access to computer data and storage devices, computer crashes, poor quality of internet service, etc.

15. MINORS

The Platform is intended for users aged 18 and above. The Company does not knowingly collect Personal Information from minors. If a parent or guardian believes a minor has provided Personal Information to the Company, they should contact the Company immediately at contact@paisaguru.net.

16. LIMITATION OF LIABILITY

The Company shall not be liable to the User for any loss of profit, production, anticipated savings, goodwill or business opportunities or any type of direct or indirect, incidental, economic, compensatory, punitive, exemplary or consequential losses arising out of performance or non-performance of its obligations under this Privacy Policy.

The Company is not responsible for any actions or inactions of any third parties that receive the User's Information.

Notwithstanding anything contained in this Privacy Policy or elsewhere, the Company shall not be held responsible for any loss, damage or misuse of the User's Information if such loss, damage or misuse is attributable to a Force Majeure Event (as defined in the Terms).

17. OPT-OUT

The Company may send email communications to the User in response to queries raised at contact@paisaguru.net. The Company does not currently send unsolicited promotional or marketing communications. Should such communications be introduced in the future, the User will be provided with an opt-out mechanism at that time.

18. GOVERNING LAW AND DISPUTE RESOLUTION

In the event of any Personal Data breach or violation of any rights and obligations under this Privacy Policy by the Company, the User shall have the right to make a complaint to the Data Protection Board to investigate the alleged violation.

This Privacy Policy shall be governed by and interpreted in accordance with the laws of India. The place of jurisdiction shall be India. In the event of any dispute arising out of this Privacy Policy, the same shall be settled by binding arbitration conducted by a sole arbitrator, appointed jointly by both parties and governed by the Arbitration and Conciliation Act, 1996, as amended from time to time. The venue and seat of arbitration shall be in India.

19. GRIEVANCE REDRESSAL MECHANISM

For registering concerns, complaints or grievances in relation to any violation of this Privacy Policy or applicable laws, please write to the designated officer of the Company at the below-mentioned email address. The designated officer shall redress the concerns in accordance with applicable laws.
